Third Quarter Patent Litigation Round-up
RPX has published its analysis of patent litigation and market trends for the third quarter. In this quarter, some lingering uncertainties from Q2 were resolved, as judicial rulings further clarifying various Supreme Court decisions and proposed reforms particularly around patent eligibility set the stage for additional changes to the patent ecosystem in the months ahead.

Massive Realtime Data Campaign Soldiers on
The long-running patent litigation campaign brought by Realtime Data LLC continues to target new defendants. In recent months, Realtime Data LLC (RTD) and its subsidiary Realtime Adaptive Streaming LLC (RAS) expanded their campaign, filing additional suits against more than a dozen companies. With these additional filings, the total number of defendants targeted in this growing litigation campaign surpassed 115, and the number of patents asserted holds at just shy of 40.
Read more »Most of the asserted patents have been developed and asserted by RTD and are related to data compression, with others relating to how operating systems and applications load when starting up a device. At issue in RTD’s recent complaints are the defendants’ cloud computing systems. RAS has asserted patents developed by RTD, as well as two developed elsewhere. Companies targeted throughout the campaign include those that offer video streaming services; cloud service providers; develop smart televisions, set-top boxes, and DVD players; and makers of smartphones and tablets.
In September, RPX completed a transaction that resolved litigation brought by RTD for certain defendants. RTD was formed in New York in May 1999, and also registered in Texas in May 2011.
Chinese Patent Litigation by the Numbers
The amount of Chinese patent litigation has nearly tripled in the last decade, going from slightly over 1,000 cases closed per year in the mid-2000s to nearly 3,000 cases closed in 2016. This dramatic rise in patent litigation in China creates a need for insight into how the system performs—what kinds of cases are brought, how those cases turn out, and the potential risks posed by remedies in those cases.
