Delaware Was 2019’s Top Patent District, but West Texas Has Been Rising in 2020

In the fourth quarter of 2019, the District of Delaware was the most popular district for patent litigation overall, also holding the top spot for both NPE and operating company litigation. For NPEs, the Eastern District of Texas—long favored by such plaintiffs prior to the Supreme Court’s TC Heartland decision—fell to third place, overtaken by the Western District of Texas.
Furthermore, as noted in another recent Data Byte and in this week’s RPX Weekly Newsletter, the early numbers for 2020 show that NPEs have been filing in West Texas in ever increasing numbers, elevating Judge Albright’s district to the top of the list of most popular districts with such plaintiffs—above both the Eastern District of Texas and the District of Delaware.
