RPX’s dataset on Chinese litigation covers approximately 21,000 cases and more than ten years of litigation history. Taking a closer look at the decade, the amount of patent litigation lawsuits in Chinese courts has nearly tripled. In the mid-2000s, slightly over 1,000 cases closed per year, but that number significantly increased in 2016, when nearly 3,000 cases closed.
The decline depicted in 2018 in the chart below may not be representative and could largely be due to inherent limitation in the reporting of Chinese litigation data: information on pending, dismissed, and settled cases is not always available and cases are not always reported immediately upon closure. As a result, totals for 2018, and even 2017, are likely to rise as additional information becomes available.
